CareerCross Terms of Service for Job Seekers

Operator: CareerCross Co., Ltd. (hereinafter referred to as the "Company")
Preamble
These Terms of Service (hereinafter referred to as the "Terms") set forth the terms and conditions for the various services related to "CareerCross" provided by the Company (as defined in Article 1). Users shall use the Services after agreeing to these Terms.
Where a user registers for an account, the user shall complete the registration procedure after agreeing to these Terms. Even if a user has not registered for an account, where the user uses the Services, the user shall be deemed to have agreed to these Terms.
Article 1 (CareerCross)
- "CareerCross" (hereinafter referred to as the "Services") means the collective term for the job search and recruitment information services provided by the Company through its website on the Internet and related functions, and various related services, including the provision of information, communications, application support, and recruitment services.
- Users shall use the Services in accordance with these Terms and any separately presented terms of use, notices, and other conditions provided by the Company through the Services.
- Where the Company reasonably determines that it is inappropriate to provide the Services to a user, the Company may refuse the user's use of the Services.
Article 2 (Components of the Services)
The Services primarily consist of the following services. The Company may change the content of each service depending on users' use of the Services, changes to the functions of the Services, or other circumstances.
(1) Job Listing and Application Service
A service that allows users to view job listings posted through the Services and submit job applications.
(2) Scout and Offer Service
A service under which part of the information registered by users may be disclosed to recruiting companies, enabling users to receive offers and other communications from recruiting companies.
(3) Information and Notification Service
A service that provides information and notifications relating to job searches, employment opportunities, and other matters by email, notifications through the Services, or other means (including communications from the Company's staff).
(4) Recruitment Service (Agent Service)
A service under which the Company or employment placement businesses affiliated with the Company select job information based on a user's experience, skills, preferences, and other factors (including, but not limited to, job recommendations information generated by the system used by the Company), and provide job referrals, application support, advice relating to the recruitment process, and other related services.
(5) Other Ancillary Services
All other services provided by the Company through the Services in connection with the foregoing.
Article 3 (Registration)
- Where users wish to use functions of the Services for which the Company requires member registration, users shall register for membership in accordance with the procedures prescribed by the Company. (Users who have completed member registration are hereinafter referred to as "Members".)
- Users shall keep their registration information accurate and up to date and shall promptly update such information whenever any changes occur.
- Users shall not intentionally register or provide false information.
- As a general rule, users shall maintain only one account per person and shall not register multiple memberships.
- Where the Company reasonably determines that any of the following applies, the Company may refuse member registration, cancel registration, suspend use of the Services, or take other appropriate measures.
(1) Where the registration information contains any false information, errors, or omissions.
(2) Where multiple registrations or any other unauthorized registration is suspected.
(3) Where the user has previously been subject to suspension of use or other measures due to a violation of these Terms or for any other reason.
(4) Where the Company otherwise reasonably determines that the registration is inappropriate.
Article 4 (Management of IDs and Passwords)
- The Company shall assign IDs and passwords, etc. (hereinafter referred to as the "IDs, etc.") to Members.
- Members shall strictly manage their IDs, etc. at their own responsibility and shall not allow any third party to use them, or transfer, lend, or change the registered name of the IDs, etc.
- The Company may deem all acts carried out using the IDs, etc. to be acts of the relevant Member.
- If a Member becomes aware of any unauthorized use of, or the risk of unauthorized use of, the Member's IDs, etc., the Member shall immediately notify the Company and comply with the Company's instructions.
Article 5 (Job Listing and Application Service)
- Users may view job listings available through the Services and apply to recruiting companies in the manner prescribed by the Company.
- Users shall ensure that the information they provide to recruiting companies in connection with their applications is accurate and up to date.
- Users shall, at their own responsibility, directly confirm with the recruiting company the working conditions and any other information necessary for employment before entering into an employment contract or any other agreement.
- The Company may view and record the content of messages for the proper operation of the Services, the prevention of labor-related disputes, the confirmation of placement status, and the improvement of matching accuracy, and users hereby consent to this in advance.
Article 6 (Scout and Offer Service)
- The Company may, in connection with the Scout and Offer Service, disclose to recruiting companies part of the information registered by users, together with information regarding users' use of the Services (hereinafter collectively referred to as the "Disclosed Information").
- The scope of the Disclosed Information, whether such information is disclosed, and the manner of such disclosure shall be in accordance with the functional specifications of the Company and the settings configured by users.
- Communications, negotiations, recruitment processes, and other interactions between users and recruiting companies shall be conducted at the responsibility of the users and the recruiting companies. Notwithstanding the foregoing, the Company may view and record the content of messages for the proper operation of the Services, the prevention of labor-related disputes, the confirmation of placement status, and the improvement of matching accuracy, and users hereby consent to this in advance.
The Company shall obtain the user's explicit consent at the time of member registration or upon the user's first use of relevant function with respect to the viewing or recording of message content as set forth in the preceding paragraph. Where the user does not provide such consent, the Company may restrict the provision of all or part of the relevant functions.
Article 7 (Display Optimization, Analytics, Job Recommendations, and Staff Communications)
- The Company may analyze users' registration information, activity history on the Services, usage of the Services, and other information, and use the results of such analysis to optimize the display of job information and notifications, improve the Scout and Offer Service, and for other similar purposes.
- The display of job information or notifications referred to in the preceding paragraph may include individual recommendations made by the Company's staff (including personnel of the Company's service providers and contractors) and communications or guidance to users.
- The analysis referred to in the preceding paragraphs may use machine learning and other methods.
Article 8 (Prohibited Conduct)
Users shall not engage in any of the following conduct in connection with the use of the Services:
(1) Registering or providing false or inaccurate information.
(2) Infringing the copyrights, trademarks, privacy, portrait rights, reputation, or other rights of any third party (including, but not limited to, such rights).
(3) Defaming, slandering, or threatening any specific individual or organization.
(4) Violating any laws or regulations, public order and morals, or generally accepted social standards, or engaging in conduct that may do so.
(5) Reproducing, selling, publishing, using by any means, or providing to any third party any information obtained through the Services beyond the scope of private use.
(6) Unjustly demanding money or other benefits from the Company or any third party, or causing disadvantage or damage to the Company or any third party.
(7) Interfering with the operation of the Services or damaging the credibility of the Company.
(8) Being an organized crime group or other anti-social force, or having a relationship with such anti-social force that is socially condemnable.
(9) Any other conduct that the Company reasonably determines to be inappropriate.
Article 9 (Intellectual Property Rights)
- The intellectual property rights in the content (including text, images, logos, and other materials) posted or displayed through the Services belong to the Company or the legitimate rights holders authorized by the Company.
- Users shall not reproduce, republish, or otherwise use any content without the prior authorization of the Company or the relevant rights holder.
Article 10 (Handling of Personal Information and Disclosure Settings)
- The Company shall appropriately handle users' personal information in accordance with the Privacy Policy (or Privacy Statement) separately established by the Company and these Terms.
- Where a user applies to a recruiting company through the Services or otherwise uses the Services for such purpose, the user acknowledges and agrees that the user's information may be provided or disclosed to the relevant recruiting company.
- As a general rule, the Company does not actively collect sensitive information, such as information relating to a user's beliefs or medical history. Where a user voluntarily provides such information, it shall be handled in accordance with the Privacy Policy or other applicable policies.
- Users may, through the methods prescribed by the Company, configure or change the disclosure settings for their registration information in connection with the Scout and Offer Service and other services (including the scope of information displayed to recruiting companies).
- Users may, by using the functions prescribed by the Company, configure the Services so that all or part of their information is not displayed to specific recruiting companies (for example, their current employer).
- The availability of the settings referred to in the preceding two paragraphs, the scope of such settings, and the timing at which such settings take effect shall be subject to the specifications of the Services.
Article 11 (Use of Statistical Data, etc.)
The Company may, regardless of whether a user has registered for or withdrawn from the Services, create statistical data, attribute information, and other information in a form that does not identify any individual from usage history and other information relating to the Services, and may use such data and information for market research, machine learning, consideration, development, and improvement of the Services, and other similar purposes.
Article 12 (Changes, Suspension, Termination of Services / Withdrawal)
- The Company may modify or suspend the provision of all or part of the Service without prior notice to users when the Company deem it necessary, including for maintenance, inspection, updates, troubleshooting, or other operational reasons.
- The Company may terminate all or part of the Service at the Company’s discretion.
- Members may cancel their membership registration (withdraw) at any time by following the procedures prescribed by us. After withdrawal, members will no longer be able to use member-only features.
Article 13 (Suspension of Use and Cancellation of Registration)
The Company may, without prior notice to the user, take measures such as suspending the user's use of the Service, deleting content, or canceling the user's registration if the user violates these Terms or if the Company reasonably determine that there is a risk of such violation.
Article 14 (Disclaimer and Limitation of Liability)
- Users shall use the Service at their own discretion and responsibility.
- The Company do not guarantee the accuracy, completeness, legality, or other aspects of job postings or other information provided through the Service.
- Except in cases where the Company have acted intentionally or with gross negligence, the Company shall not be liable for any damages incurred by users arising from their use of the Service.
- Even in cases where the Company are liable pursuant to the preceding paragraph, the Company’s liability shall be limited to direct and actual ordinary damages incurred by the user.
Article 15 (Compensation for Damages)
If a user violates these Terms or causes damage to us or any third party in connection with the use of the Service, the user shall compensate us or such third party for any and all damages, whether direct or indirect.
Article 16 (Modification of these Terms)
- The Company may modify these Terms when reasonably necessary, including due to amendments to applicable laws and regulations, changes to the specifications of the Service, or other circumstances.
- If the Company modify these Terms, the Company will post the revised Terms and the effective date of such modifications on the Service website and provide notice thereof for a reasonable period of time. In the event of material changes to these Terms, the Company may require users to provide explicit consent again, such as upon login. If a user uses the Service after the effective date of the revised Terms, the user will be deemed to have agreed to the revised Terms.
- If a user does not agree to the revised Terms, the Company may, after taking reasonable measures such as providing a reasonable grace period, suspend the user's use of the Service and, if the user is a Member, proceed with the cancellation of their membership.
Article 17 (Governing Law and Jurisdiction)
These Terms shall be governed by the laws of Japan. Any and all disputes arising out of or relating to the Service or these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
